Sexual violence has no rules.
This is not hit or flirt. This is not a game.

This is any form of sexual contact,
which you did not want. It occurs always
when you say “no” or you cannot
say it - also in a committed relationship.
It can be associated with blackmail, threats
or abuse of your trust.
IN THE CLUB
Music, dance, fun. You drink and suddenly you lose control over your body. Somebody bothers you. Harasses. You cannot say a strong “no” because you are not able to. It’s rape.

“Whoever, using the helplnessness of another person or the ability of this person, due to mental retardation or mental illness, to recognize the meaning of an act or govern his/her own conduct, forces a sexual intercourse or another sexual act or to perform such act, is subject to imprisonment from 6 months to 8 years.” CC Art. 198.

ON THE TRAM
Are you coming home during rush hours? The tram is crowded, you can barely breathe. Someone next to you stands definitely too close. He nudges, and you feel less and less comfortable with it. It’s harassment.

“If the culprit in the manner specified in § 1 (by force, unlawful threat or trick) forces another person to undergo other sexual act or to perform such act, is subject to imprisonment from 6 months to 8 years.” CC Art. 197 § 2.

HOUSE PARTY
“It’s only a joke” - you can hear each time, although it does not make you laugh. House party at friends? Everyone knows each other and they like each other, so you think it’s a safe party. Suddenly someone familiar intensely persuades you to come closer. Words are humiliating and aggresive, and gestures are sexual? It’s harassment.

“If the culprit in the manner specified in § 1 (by force, unlawful threat or trick) forces another person to undergo other sexual act or to perform such act, is subject to imprisonment from 6 months to 8 years.” CC Art. 197 § 2.

AT HOME
If you love me, do it. You do it or I will leave you - you hear it once in a while, but you do not want to do it.
Forcing another person to have a sexual intercourse is rape.

“Whoever by force, unlawful threat or trick forces another person to have a sexual intercourse, is subject to imprisonment from 2 to 12 years.” CC Art. 197 § 1.

AT WORK
Minor malice: remarks about your appearance and clothes. Piercing eyes, excessive attempts to make contact. It’s all in the workplace and thanks to the supervisor or the associate. Everyday you are afraid of physical violence. It is verbal and non-verbal harassment.

“Whoever, through the abuse of the relationship of dependency or the use of a critical position, forces another person to undergo a sexual intercourse or to perform another sexual act or to perform such act, is subject to imprisonment of up to 3 years.” CC Art. 199 § 1.

ON THE STREET
On the street, in the park, in the staircase. During a walk, in the very center of the city or near the place of residence. You can experience exhibitionism in the least expected situation. It’s harassment.

“Whoever publicly presents pornographic content in such a way that it may force the person who does not wish to do so, to see it, is subject to a fine, restriction of liberty or imprisonment up to one year” CC Art. 200 § 1.
